What is a swimming pool compliance certificate?

A swimming pool compliance certificate is an official document issued by local council or a private certifier to confirm that a swimming pool or spa complies with all relevant safety regulations and standards. It serves as proof that the pool meets the necessary requirements for safety barriers, fencing, gates, and other safety features as mandated by local or state laws. This certificate is often required for various purposes such as property sales, rentals, or to ensure ongoing compliance with regulations.

What our customers have to say

What Australian Standard version will Darook use to inspect my swimming pool?

We conduct all our inspections in accordance with the latest Australian Standard for swimming pools, AS1926.1 (2012). If you prefer to have your pool assessed using an older version of the Australian Standard, it is advisable to seek approval from your local council officer.

Does my swimming pool need to be registered on the NSW Swimming Pools Register?

In NSW, swimming pools must be registered. Owners can easily do this online by filling out the NSW Swimming Pool Registration Form.

What happens if my swimming pool fails the pool safety inspection?

If your swimming pool doesn't pass the pool safety inspection, you will receive a comprehensive and easy to read report detailing the defects and recommendations on how to fix the defect. Should our inspector determine that the property poses a public safety hazard, we are obligated to promptly alert the council.

From the date of the initial swimming pool inspection, you have a six-week window to address any non-compliant items. Failure to resolve these issues within this timeframe will result in us sending a copy of the non-compliance notice to the council as required by law.

Frequently Asked Questions

Fines of $550 can be issued on the spot for non-compliance with pool safety regulations. In certain cases, penalties for such non-compliance can reach up to $5500. This is why it’s absolutely vital to have a fence that meets the Pool Fence Compliance Certificate NSW standards and regulations.

If you are renting out your property, your certificate will remain valid for 3 years, regardless of how many times your tenants change.

Take a look at the NSW swimming pools checklist – it simplifies the swimming pool requirements found in AS1926.1 (2012). It will help you understand what the pool safety inspector will assess and makes it easy to see if your property meets the required swimming pool standards.

When selling a property with a swimming pool or spa pool, owners must ensure that the contract of sale includes a registration certificate issued from the Swimming Pool Register, along with one of the following:

  1. A valid swimming pool certificate of compliance in NSW.
  2. A relevant occupation certificate issued within the last 3 years.
  3. A certificate of non-compliance.

If any of the above documents are missing, the purchaser has the right to rescind the contract within 14 days of exchange, unless settlement has already occured.

In the event that a certificate of non-compliance is attached to the contract, the purchaser becomes responsible for obtaining a swimming pool compliance certificate. They will have 90 days from settlement to address and rectify any defects listed in the certificate of non-compliance in order to obtain the necessary certificate of compliance.
